S. Africa deputy president cagey on leading ANC

PRETORIA, South Africa (AP) ? South Africa's deputy president says he is "agonizing" over whether he would accept leading the governing African National Congress if he's chosen during the party's convention next month.

Deputy President Kgalema Motlanthe remained cagey Friday when speaking with journalists in Pretoria as part of an event organized by the Foreign Correspondents' Association of Southern Africa.

Some local ANC groups have nominated Motlanthe to take over leadership of the ANC. Typically, whoever leads the ANC becomes the party's presidential candidate. Elections are slated for 2014.

President Jacob Zuma, 70, currently leads the party. While avoiding criticizing Zuma, Motlanthe said corruption has eaten away at the ANC since it became the nation's governing party at the end of apartheid.

For example, several said he would park the bus and run personal errands, making the bus late. Management verified several complaints by checking the tape from the bus?s onboard video camera system. It disciplined Jerome. If a complaint couldn?t be verified, it wasn?t used.

Finally, Jerome was fired and he filed an internal grievance. Metro Transit reinstated him as a compromise, and he dropped the grievance. Still, the complaints rolled in and he was fired again.

He sued, alleging that because he had been reinstated, that meant he must have been performing his job to expectations and that none of his prior behavior could be used to justify his termination.

The court disagreed. It saw the reinstatement as a one-time gift, not an admission that Metro Transit had made a mistake by firing Jerome. It was free to use the past conduct against him. (Paul v. Metropolitan Council, No. 10-4759, DC MN, 2012)

John Wiggins Digs Backyard Mine as 'Memorial ... - AOL Real Estate

An English homeowner has given new meaning to the phrase "it's all mine!" John Wiggins (pictured above) spent 13 years digging a mine below his backyard garden in the village of Skelton Green in northeastern England. He employed such precision and attention to detail that the replica mine looks like one you might find a mile below ground in the Appalachians -- but his is only 15 feet down.

Wiggins explained to the Darlington and Stockton Times newspaper in Weybridge, England, that his interest in ancient ruins combined with a love for local mining history in the larger English town of Cleveland motivated him in the painstaking project.


"I moved in here 15 years ago," said the 68-year-old painter. "I started to become interested in local history, and this part of the world is notorious for its mining background."

The area was home to 100 iron mines in the 1800s, but by the 1960s most of them were shut down.

"I visited a mine nearby in North Skelton," Wiggins continued, "and it was an experience I'll never forget. But it made me want to preserve Cleveland's identity, so, as you do, I decided to dig up the garden."

He used a backhoe to dig out the 150-foot-long corridor of his model mine. Inside is a railway that he built for a makeshift tram to carry ironstone. Using reclaimed materials from local builders and markets, he built the walls of the mine and two headstocks that serve as the shafts where workers and ironstone would be lifted out of the mine. The whole thing is ventilated to prevent water from flooding the mine and allow fresh air and a little light inside.


The last part of the project that Wiggins has left to complete is a mine office.

"I want it to look authentic, like it's from the 1840s," Wiggins said. "I want it to look abandoned, as if miners just up and left. ... Everything is an exact version of what was in the smaller old mines. I've consulted experts, used my own knowledge of ironstone mines and read a lot of old books to get everything accurate."

According to the British tabloid, The Sun, it cost Wiggins "thousands of pounds" to create the mine.


He called his underground masterpiece a "memorial ... to the ironstone miners of Cleveland" and said that he wasn't aware of anything else like it in the area. He added that he is willing to offer free tours of his mine to those interested in learning more about the town's mining history.

While Wiggins built a model of a historic treasure on his property, a real age-old find was discovered in a home in the nearby English town of Plymouth earlier this year. In August, homeowner Colin Steer discovered a 33-foot-deep well under his living room floor that dates to the 16th century.

Saudi Military Attaché Gunned Down During His Commute To Work In Yemen

Yemeni officials said the Saudi official that was gunned down in the capital Sanaa on Wednesday was an assistant military attach? working at the Saudi Embassy in the country that has become the base of operations for Al Qaeda in the Arabian Peninsula (AQAP).

"Gunmen opened fire at the Saudi diplomat's car in a neighborhood in southern Sanaa, killing him and his Yemeni bodyguard," an unidentified Yemeni security official told Reuters, who also said the gunmen were dressed in uniforms identifying them as security officers.

The attack involving an undislocsed number of assailants in a drive-by shooting is the latest in an increasingly unstable, impoverished country that has threatened the security of its wealthier oil-rich northern neighbor. In addition to the presence of AQAP militants, some of whom are radical Saudi dissidents seeking to overthrow the pro-Western Saudi royal family, the country?s restless northern border and its Houthi Shiia insurgency is seen as a thorn in Saudi Arabia?s side.

The attack took place in Hada, the city?s diplomatic quarter. The gunmen opened fire on the attach??s vehicle as he was being driven to work at the Saudi embassy, according to Al Jazeera.

The Saudi Foreign Affairs Ministry had yet to issue a statement. The attack comes as Gulf Cooperation Council (GCC) Defense Ministers are meeting in the Saudi capital Riyadh to discuss regional security. The security situation in impoverished Yemen, the only state in the Arabian Peninsula that is not a member of the GCC, will likely be discussed in light of this recent assassination of a Saudi diplomat.

Meanwhile, Saudi deputy consul Abdullah al-Khalidi remains a hostage in Yemen?s southern port city of Aden. The official was kidnapped March 28 by members of Al Qaeda demanding a ransom and the release of female prisoners.

A wave of deadly attacks in Saudi Arabia between 2003 and 2006 led to a massive nationwide crackdown that sent militant fleeing south to rugged an unstable Yemen, where militant jihadists welcomed them.

Saudi Arabia later played a role in a power-transfer deal that replaced President Ali Abdullah Saleh with President Abdrabuh Mansur Hadi. Saleh was nearly taken out in an RPG attack in June of last year. In January Saleh departed Saudi Arabia for New York City to seek medical treatment for an unreported condition.

But the security situation has only worsened under the new leadership. In October, unidentified militants assassinated a high ranking Yemeni security official that was working for U.S. State Department at its embassy in Sanaa. Earlier this year Yemeni soldiers had to be deployed to Abyan province in the south to re-take several towns that had been taken over by militants.

In 2009, Saudi Arabia participated in an offensive with Yemen?s army against Shiia insurgents in the north fighting their own battle against the state separate from AQAP?s. In an unprecedented move, the Saudi Arabia army and air force attacked targets outside of its borders in what is claimed was a defensive move against ?infiltrators? that had crossed into the kingdom from Yemen to attack towns inside the country.

The Yemeni army attacked from the south in an offensive called Operation Scorched Earth. It displaced hundreds of thousands of locals, creating a refugee crisis. The final death toll is inconclusive, but both governments claimed hundreds of Houthi fighters were killed along with roughly 250 soldiers from both countries.?

Newport: Another ?PushPin? Art Show at the Visual Arts Center ...

The PushPin Show 2012 has been scheduled in the Runyan Gallery at the Newport Visual Arts Center from December 8 through December 30. Oregon Coast Council for the Arts (OCCA) invites Lincoln County artists of all ages and levels of experience to show their artwork in the Runyan Gallery at the Newport Visual Arts Center (VAC). All Lincoln County residents including beginners, emerging artists, established professionals, craftspersons, hobbyists and dabblers, youngsters, oldsters, college students, retirees and families are invited to participate.

To enter the show, bring your artwork to the Runyan Gallery at the Newport Visual Arts Center on Friday, December 7 or Saturday, December 8 between 11 am and 4 pm. There will be volunteers ready to help you enter the show. The gallery will close promptly at 4pm on Saturday to allow OCCA to set up the opening reception that starts at 5:00pm. The Opening Reception for the artists and the community is from 5:00pm to 7:00pm on Saturday, December 8. Everyone is welcome to meet the artists and view the exhibit. Refreshments will be served.

Rules for the PushPin Show:
1) The artwork must be original. No prints or facsimiles.
2) You must be able to hang your artwork with just 4 or fewer pushpins. Each artist should hang their own work.
3) Work should be no larger than 48? x 48? so there is enough wall space for everyone.
4) This is a family oriented community show, and OCCA asks that the work be appropriate for all audiences.
5) Artwork may be for sale, and OCCA encourages you to put a price on your work. OCCA retains a 30% commission if you are an OCCA member and a 35% commission for those who are not members.

The original PushPin Show was the brainchild of local artist and art activist Jimmy Frankfort. And while it has grown over the years, it still adheres to an inclusive, all county resident?s show that exemplifies Oregon Coast Council for the Art?s mission to celebrate, promote and develop community arts. The PushPin Show brings together the resources of the VAC, the diverse talents of Lincoln County artists, and the public to celebrate and support our local art. PushPin is a great opportunity to showcase your artwork in a gallery or to purchase a piece of art.

Visitors to the PushPin Show will have the opportunity to vote for their favorite piece. The ?People?s Choice? winner and runners up, determined by votes submitted throughout the show, will be announced at the gallery opening reception on January 4, 2013.

JYP Entertainment has confirmed today that Wonder Girls? Sun Ye will be tying the knot with her boyfriend in 2013.?

Rumours that the Wonder Girls leader will be marrying her boyfriend were confirmed today after it was confirmed her agency, JYP Entertainment. The agency revealed that Sun Ye and her newly-engaged-fianc?, who she met during volunteer work will join hands early next January on the 26th.

?After long hesitations, she brought this news to the agency and we decided to respect her decision.? The agency said.

Sun Ye also revealed that she will be focusing on her marriage and her new family while the other Wonder Girls members will be actively acting and producing their own solo albums.

While the location has not been announced, the singer told?Beatles Code Season 2?in July that it was ?possible? that she would get married in Haiti, where the two lovebirds met and volunteered.

California man accused in plot to join al Qaeda denied bail

RIVERSIDE, California (Reuters) - A California man accused alongside three co-defendants of conspiring to provide support to al Qaeda and Taliban militants plotting attacks against Americans overseas was ordered held without bail on Monday by a federal judge.

Arifeen David Gojali, 21, was arrested with two others last week outside a southern California apartment complex by authorities who said the trio had imminent plans to travel to Afghanistan via Mexico and Turkey to prepare for "violent jihad."

A fourth man, accused ringleader Sohiel Omar Kabir, 34, was apprehended in Afghanistan and remains in custody there, according to the FBI.

"I specifically find that the defendant poses a serious risk of flight and a danger and the defense has not rebutted to the contrary," U.S. Magistrate Judge Sheri Pym said in ordering Gojali jailed without bond.

Defense attorneys did not contest Pym's ruling during proceedings in U.S. District Court in Riverside, 60 miles east of Los Angeles, and said outside court that Gojali and his family could not afford to post bond.

"When you can't get over that hurdle, there's nothing you can do," attorney John Aquilina said of his client, who was escorted into court by U.S. Marshals wearing an orange jail jumpsuit and shackled at the waist.

The four defendants, all U.S. citizens or permanent residents, are charged with conspiring to provide material support to terrorists.

Kabir, the accused ringleader, is charged with recruiting co-defendants Ralph Deleon, 23, and Miguel Alejandro Santana Vidriales, 21, who converted to Islam under his tutelage. Those two are in turn alleged to have enlisted Gojali.

In conversations relayed or recorded by an unidentified paid FBI informant, Deleon and Santana spoke about traveling to Afghanistan to join Kabir and engage jihad, according to the criminal complaint. It said they described potential targets for attacks including U.S. military bases.

Together with Gojali, they also made visits to a Los Angeles firing range and a paint ball facility for shooting practice "to prepare for terrorist training oversees," the FBI said.

Kabir, a naturalized U.S. citizen who lived in the Los Angeles suburb of Pomona before going abroad in late 2011, was born in Afghanistan and served in the U.S. Air Force from 2000 to 2001, according to the FBI.

The FBI has declined to elaborate on Kabir's status or discuss when he might be returned to the United States to face charges, saying only that he remained in custody in Afghanistan.

They each face up to 15 years in prison if convicted of conspiring to provide material support to terrorists.

World shares, euro fall ahead of Greek decision

Stocks, commodities and the euro zone single currency were steady or slightly weaker following strong gains seen over the past week as investors priced in the likelihood of a Greek deal.

"On the most pressing issue for the markets into year end, that of the tax and spending issues in the U.S., the Sunday morning talk shows didn't reveal that we're on the cusp of a deal as more horse trading will go on in the weeks to come," said Peter Boocvkar, managing director at Miller Tabak & Co in New York.

The Dow Jones industrial average was down 90.38 points, or 0.69 percent, at 12,919.30. The Standard & Poor's 500 Index was down 8.90 points, or 0.63 percent, at 1,400.25. The Nasdaq Composite Index was down 10.96 points, or 0.37 percent, at 2,955.89.

The MSCI world equity index, which gained nearly 4 percent over the week to November 23 for its biggest weekly gain since April, was down 0.3 percent to stand at 328.95.

"Last week was very good for the markets and it seems that investors are taking a breather ahead of the euro zone meeting," said Koen De Leus, senior economist at KBC in Brussels.

Euro zone finance ministers and the International Monetary Fund began their third meeting in as many weeks on Monday to try to seal a bailout deal for Greece but must still agree how to cut the country's debt pile to a more sustainable level.

The euro was last down 0.2 percent against the dollar.

Acne in Women Can Signal Hormone Problems

Acne in adult women is common, but in some cases, it can signal an underlying hormonal disorder, experts say.

Identifying such cases is important, not only to better treat women's acne, but to correct hormone imbalances that can lead to other health problems, said Dr. Kanade Shinkai, a dermatologist at the University of California, San Francisco School of Medicine, who specializes in acne treatments.

However, doctors often simply give women prescriptions for acne treatments, such as antibiotics, which typically don't work for acne caused by hormone imbalances, Shinkai said

Women who visit the dermatologist for acne and who experience signs of a hormonal disorder, such as irregular periods, should discuss their symptoms with their doctors, Shinkai said.

In addition, it's important for dermatologists to conduct a thorough medical history of their patients so that they can identify hormonal disorders that manifest as acne, she said.

Symptoms

Acne in adult women is often hard to treat. One study showed that 80 percent of women prescribed antibiotics for acne receive no benefits from the drugs, Shinkai said.

In these cases, the acne may stem from normal hormonal changes, such as those that occur around the menstrual cycle, or from a true hormonal disorder. For many of these women, medications that target hormones, rather than skin bacteria, would provide the most help, Shinkai said.

Women with acne may have elevated levels of male hormones such as testosterone, Shinkai said. Symptoms of this type of hormonal imbalance include hair growth on the face, a deepening of the voice, increased muscle mass and decreased breast size.

The most common cause of such a hormonal change is a condition called polycystic ovarian syndrome, or PCOS. Women suspected of having a hormonal disorder can be diagnosed by having a doctor check their blood for elevated levels of male hormones, or in the case of PCOS, an ultrasound of the ovaries.

Treatment

If a woman has PCOS or another type ofhormone imbalance, treating the underlying hormonal problem will help with the acne, Shinkai said.

Shinkai typically prescribes birth control pills to patients with PCOS, to lower their levels of male hormones. If those pills don't work by themselves, Shinkai adds another drug called spironolactone.

If left untreated, the hormone imbalances associated with PCOS may increase a woman's risk of cancer, as well as diabetes and obesity, which bring their own sets of medical problems, Shinkai said.

Birth control and spironolactone can also work very well against acne even in women with no hormonal disorder, Shinkai said.

Deal with an unsuccessful franchise | Entrepreneurindia.in

Franchising is an easy way to expand your business where franchisees look to replicate your success. But what if they cannot?

Franchising is a great way to leverage your brand value if you wish to expand to new territories at a fast pace, with the surety that you preserve your business? core values. It also allows budding entrepreneurs to own a business with the confidence of an established brand and not of a complete newbie.

But, there may come a time when a particular franchisee fails or is unsuccessful; and in the best interest of your company, you may decide to discontinue. What constitutes failure is relative and is different for different businesses. The reasons to shut an unsuccessful franchise could be as follows:

(i) Dip in business
When a decision to open a franchise is done, a franchisor generally conducts a feasibility report on the potential of business from the area.

While a plunge in business can be temporary, a prolonged and sustained weak business can be a drag on the company. In such cases, the franchise may be tagged as unsuccessful.

(ii) Breach by franchisee
A situation where the franchisee does not follow the franchise agreement or works/functions contrary to it is termed as a breach of franchise. A franchising agreement is at the core of the contract, and when not adhered to can result in business losses and unsuccessful working.

(iii) Other grounds
There are other reasons which may render a franchisee unsuccessful. This may include aspects such as failing to enter into a lease or renewing of an expired lease, failing to obtain or renew the required insurances or licenses to operate, the franchisee becoming bankrupt, franchisee being convicted of a criminal case or civil offence, or conducting the business in a way that is detrimental to the company.

So what are your options as the franchisor and brand owner? How long should you wait? What is the worst-case scenario for you? We take a look.

Work it out
When the franchisor feels that his franchisee is going nowhere, he should reach out to the latter and have a chat.?For grounds like a dip in business, in most cases, helping the franchisee overcome the hurdle works best for both, the franchisor and the franchisee.

A lot of time has been invested in getting the franchisee up and running and it is always advisable to make the effort to rectify the problem/s.?Generally, a written communication should be made to the franchisee, giving him at least a 30-day period for course correction.

Mandatory and binding arbitration clause
If any of the disputes cannot be resolved amicably, the franchise agreement must provide for a clause under which concerned parties must mutually recognize and agree that it will be in their best interests to resolve their differences in a minimum time frame and money, and submit it to arbitration.

In such a case, the parties agree that they will not file any law suits or claims against each other without first submitting their grievances to mandatory and binding arbitration.

Terminating an agreement
Despite several attempts, if the franchisee is not able to and unwilling to correct the problems; and the franchisor feels there can be no going back on the agreement, terminating the franchisee agreement may be the only way out.

The reasons for the termination can be commercial factors like when the association is not commercially viable even after repeated attempts to improve the position, or the franchisee becoming bankrupt, or getting involved in any criminal activity.?It may also be the case that the franchisee, for some reason, wants to opt out of the agreement or does not want to renew it when it expires.

The last recourse
The decision to terminate a franchisee agreement should be the last recourse. Primarily, it always helps to have your lawyer go over all the documents and iron out any legal matters.Before the actual termination procedure starts, it would help if the franchisee was told about the decision to part ways and his side of the case heard, if needed.

Generally, every franchisee agreement contains a termination clause and the process contained in that clause is followed.Usually, the franchisor would serve a legal notice to the franchisee informing him about the termination of the agreement. Upon termination of this agreement for whatever the reason, the franchisee will cease to operate, conduct, exploit and use the services, intellectual property rights and trademarks?of the franchisor.

The franchisee will also deliver to the franchisor all the equipment supplied by him and is generally barred from entering the premise of the franchiser, where he was earlier allowed.?The franchisee will also deliver all the unsold stock of the products supplied.

In the event of breach of license terms, the franchiser will also have the right to transfer the license to some other party of his choice including the equipment and leasehold rights of the premises. There is also a forfeiture of non-refundable license/franchisee fee for the franchisee.

Non-Compete Clause
In order to protect the systems, trade secrets, customer lists and confidential business information and knowledge acquired by the franchisee, the franchisor should ideally invoke the non-compete clause.?This clause prohibits the franchisee from competing with the business in that territory for generally a period of 24 months from the date of termination of the agreement.

(AP) ? As an Army general faces a string of sexual misconduct charges involving female officers, his wife is seeking to stir a broader look at often taboo subjects in military marriages: adultery, the strain of separation and the stress of war.

Rebecca Sinclair stayed away from the days-long military hearing earlier this month at Fort Bragg, N.C., where the allegations against her husband, Brig. Gen. Jeffrey Sinclair, were revealed in detailed testimony. Women officers described an affair, forced sexual encounters and a series of explicit email exchanges with the former deputy commander of the 82nd Airborne Division in Afghanistan.

But his wife has since made herself a public face of his defense, and of what she sees as the toll of a decade of war on military couples, many of whom have found themselves in a repeated pattern of deployments, homecomings and moves.

"I am not condoning anything, and I'm not excusing my husband's infidelity. I'm not saying that just because we're on this deployment cycle and because of the war, that causes infidelity," she said by phone Monday from New York, where she had traveled for interviews after airing her feelings in an opinion piece Thursday in The Washington Post. "I'm just trying to understand it, and I'm trying to get conversations started so that people can look behind and see the bigger issue."

Her piece came as adultery in the military has flared up as an issue, following retired Gen. David Petraeus' resignation as CIA director over an affair with his biographer and the disclosure of what officials have described as suggestive emails between a Florida woman and Gen. John Allen, the top U.S. commander in Afghanistan; he says he's done nothing wrong.

It also comes as Jeffrey Sinclair waits to hear whether he'll be court-martialed on charges including forcible sodomy, wrongful sexual conduct, misusing a government travel charge card, and possessing pornography and alcohol while deployed. The 27-year Army veteran was relieved in May of his duties overseeing logistics for the 82nd Airborne.

At the recent evidentiary hearing, a female captain who was his direct subordinate in Afghanistan testified she had a three-year affair with her married boss. But she also said that on two occasions, the general forced her to perform oral sex and that he also threatened to kill her and her family if she told anyone about their relationship. Two other officers testified that they provided nude photos to him, part of allegations involving his conduct with five women.

The Associated Press does not name victims of alleged sexual assaults unless they agree to be identified or come forward publicly.

Defense lawyers portrayed Sinclair's primary accuser, the captain, as a lying, jealous lover trying to ruin his family and career. Defense lawyer Maj. Elizabeth Ramsey suggested in her closing argument that the general was guilty only of adultery and fraternization, punishable by a written reprimand. The defense team said Sinclair had passed a polygraph test during which he denied sexually assaulting the captain.

Rebecca Sinclair, who said her husband called last spring to tell her of the affair and allegations, said she hoped "the Army will see the evidence for what it is and will clear him of any wrongdoing."

In the meantime, the Sinclairs are trying to mend their relationship, she said. And she is pointing to her personal story as a testament to the pressures on military marriages and families.

Her husband has been deployed to Iraq, Afghanistan and elsewhere five times since the Sept. 11 terror attacks, spending a total of six of the past 11 years away from his wife and two children ? the eldest, a sixth-grader, has attended six schools so far, Rebecca Sinclair said.

Many military wives know their husbands are unfaithful but stay silent to preserve their families or their financial security, especially because their spouses' own careers can be hampered by frequent moves, said Rebecca Sinclair, who has taught business at various community colleges during her 27-year marriage.

Her husband's affair and the fallout "is very painful for me, very hurtful, but I just really feel that this is something I need to talk about," she said. "Because it's not an isolated case."

Astrophysicists identify a 'super-Jupiter' around massive star

ScienceDaily (Nov. 19, 2012) ? Astrophysicists at the University of Toronto and other institutions across the United States, Europe and Asia have discovered a 'super-Jupiter' around the massive star Kappa Andromedae. The object, which could represent the first new observed exoplanet system in almost four years, has a mass at least 13 times that of Jupiter and an orbit somewhat larger than Neptune's.

The host star around which the planet orbits has a mass 2.5 times that of the Sun, making it the highest mass star to ever host a directly observed planet. The star can be seen with the naked eye in the constellation Andromeda at a distance of about 170 light years.

"Our team identified a faint object located very close to Kappa Andromedae in January that looks much like other young, massive directly imaged planets but does not look like a star," said Thayne Currie, a post-doctoral fellow in the Department of Astronomy & Astrophysics at the University of Toronto and coauthor of a paper titled "Direct imaging of a `super-Jupiter' around a massive star" to be published in the Astrophysical Journal Letters. "It's likely a directly imaged planet."

The researchers made the discovery based on an infrared imaging search carried out as part of the Strategic Explorations of Exoplanets and Disks with Subaru (SEEDS) program using the Subaru telescope located in Hawaii.

"Kappa Andromedae moves fast across the sky so it will appear to change position relative to more distant, background objects," Currie says. "When we reobserved it in July at multiple wavelengths, we saw the faint object again, located at about the same position as it was in January. This indicates that it is bound to the star and not an unrelated background object." Labelled by the researchers Kappa And b, it could be the first direct rendering of an exoplanet in two years and of a new exoplanet system in almost four years, ending a significant drought in the field.

In a single infrared snapshot, the tiny point of light that is Kappa And b is completely lost amid the overwhelming glare of the host star. The SEEDS observing team was able to distinguish the object's faint light using a technique known as angular differential imaging, which combines a time-series of individual images in a manner that allows for the otherwise overwhelming glare of the host star to be removed from the final, combined image.

Young planets retain significant heat from their formation, enhancing the brightness at infrared wavelengths. This makes young star systems attractive targets for direct imaging planet searches. However, despite this fact, the successful direct imaging of extrasolar planets is exceptionally rare, especially for orbital separations akin to our own solar system planets. The extraordinary differences in brightness between a star and a planet are a primary reason why only a handful of planets have ever been directly imaged around stars.

"Although astronomers have found over 750 planets around other stars, we actually directly detect light from the atmosphere of only a few of them," said Currie. "There are approximately six now. Kappa And b is one of them if our estimates for its age and mass are correct, which we think they are. The rest are only inferred directly."

The large mass of both the host star and gas giant provide a sharp contrast with our own solar system. Observers and theorists have argued recently that large stars like Kappa Andromedae are likely to have large planets, perhaps following a simple scaled-up model of our own solar system. But experts predict that there is a limit to such extrapolations; if a star is too massive, its powerful radiation may disrupt the normal planet formation process that would otherwise occur. The discovery of the super-Jupiter around Kappa Andromedae demonstrates that stars as large as 2.5 solar masses are still fully capable of producing planets within their primordial circumstellar disks.

"This planetary system is very different from our own," Currie says. "The star is much more massive than our Sun and Kappa And b is at least 10 times more massive than any planet in the solar system. And, Kappa And b is located further from the star than any of the solar system planets are from the Sun. Because it is generally much harder to form massive planets at large distances from the parent star, Kappa And b could really be a challenge for our theories about how planets form."

The SEEDS research team continues to study the Kappa And b emitted light across a broad wavelength range, in order to better understand the atmospheric chemistry of the gas giant, and constrain the orbital characteristics. The researchers also continue to explore the system for possible secondary planets, which may have influenced the Kappa And b formation and orbital evolution. These follow-up studies will yield further clues to the formation of the super-Jupiter, and planet formation in general around massive stars.

CNBC, Market Watch, Forbes, Kiplinger, Wall Street Journal, CNN Money, The Street, Mark Cuban and others say that buy and hold is dead.

Lubos Pastor of the University of Chicago Booth School of Business and his colleagues have recently documented that buy and hold may never have been a viable investment strategy.

Wall Street Journal columnist Brett Arends wrote in 2010:

For years, the investment industry has tried to scare clients into staying fully invested in the stock market at all times, no matter how high stocks go?. It?s hooey?. They?re leaving out more than half the story.

Leading economist Robert Shiller strongly hinted at this possibility in research which he published 30 years ago.

As attorney, tax expert and financial writer Rob Bennett told us:

The story in brief is that Yale University Economics Professor Robert Shiller published research in 1981 that turns our understanding of how stock investing works on its head. Shiller?s findings let us all obtain far higher returns at greatly reduced risk. The problem is that, by the time Shiller published his research, many big names had already endorsed Buy-and-Hold (which was based on research discredited by Shiller). So the big shots in the field have been ignoring and then even covering up Shiller?s findings for 30 years now.

The thing that I have done that no one before me has done is to explain the
practical IMPLICATIONS of Shiller?s findings. Even Shiller has never done this.

Shiller?s book (?Irrational Exuberance?) is fantastic, but it is all theory. He never tells investors WHAT TO DO. He has explained why in public interviews. He has said that he would be branded ?unprofessional? by the experts in this field if he were to do so.

Shiller and many others have been keeping their mouths shut about the practical implications of his theory for three decades now.

Wall Street Journal?s Arends explained:

Consider the data from Professor Robert Shiller at Yale University. He tracks something known as the ?Cyclically-Adjusted Price-to-Earnings Ratio.? (These days it is also known as ?the Shiller PE?). This compares stock prices with after-tax company earnings, but only after adjusting those earnings to take account of the fluctuations of the economic cycle. This helps avoid the distortions commonly found when you compare stock prices to a single year?s earnings.

At the peak of a boom, earnings are artificially inflated, while at the trough they are artificially depressed. The Shiller PE smooths that out.

Anyone who followed the numbers would have avoided the disaster of the 1929 crash, the 1970s or the past lost decade on Wall Street. Why didn?t more people do so? Doubtless they all had their reasons. But I wonder how many stayed fully invested because their brokers told them ?You can?t time the market.?

Bennett?s website provides endorsements for his stock timing theories, and argues that the prevailing buy and hold dogma helped to cause the financial crisis:

The story is that the true cause of the economic crisis was the reckless promotion of Buy-and-Hold Investing for 30 years after the academic research showed that there is zero chance that it can ever work in the long term.

The short form of the story is that the stock market was overvalued by $12 trillion in 2000. This is public information. All in the field acknowledge that stock prices over time revert to the mean (John Bogle calls this an ?Iron Law? of stock investing). So those who were paying attention to valuations knew in 2000 that within 10 years or so close to $12 trillion of spending power would disappear from our consumer economy. An economic crisis became inevitable once we permitted stock prices to rise so high. We should tell people to lower their stock allocations when prices rise to insanely high levels both to protect their own retirements and to protect the general economy from collapse. We should encourage Valuation-Informed Indexing, described in a Guest Blog Entry I wrote for the Free From Broke site titled A Better and Less Risky Way to Invest in Stocks.

Dallas Morning News Columnist Scott Burns spilled the beans in a June 2005 column he wrote about my showing that the numbers used by most financial planners to help us plan our retirements are wildly wrong. Burns observed that the reason why we see few media reports about the errors in the retirement studies even though they will cause millions of middle-class people to suffer failed retirements in days to come if they are not corrected is that: ?It is information most people don?t want to hear.? The ?experts? (who see themselves as being in the business of selling stocks, not of giving independent and accurate investing advice) encourage us to follow dangerous strategies, and, once we do so, we become so emotionally invested in the strategies that we become hostile to hearing the realities.

Many big names have seen the merit of the new investing ideas. Carl Richards, owner of Clearwater Asset Management and author of the Behavior Gap blog, told me: ?I have read everything I can about Valuation-Informed Indexing, and I agree with you that Buy-and-Hold Passive Investing is extremely problematic? I value and respect the passion, hard work and research that you have put into this very important issue?. I think what you are doing has huge value.? Rahiv Sethie, a professor of economics at Barnard College, Columbia University said of me: ?Rob Bennett makes the claim that market timing based on aggregate P/E ratios can be a far more effective strategy than Passive Investing over long horizons (ten years or more). I am not in a position to evaluate this empirically but it is consistent with Shiller?s analysis and I can see how it could be true.? Wade Pfau, Associate Professor of Economics at the National Graduate Institute for Policy Studies in Tokyo, Japan, researched the question and learned that ?Valuation-Informed Indexing provides more wealth for 102 of the 110 30-year periods? in the historical record. Bill Schultheis, author of The New Coffeehouse Portfolio exclaimed upon discovery of my web site: ?Holy Toledo! This is great stuff!?

A calculator at my site called The Stock-Return Predictor will let you see with numbers why Buy-and-Hold is so dangerous. The calculator runs a regression analysis of the historical stock-return data to show the most likely 10-year annualized return starting from any of the various possible starting-point valuation levels. In 1982, the most likely 10-year annualized return was 15 percent real. In 2000, it was a negative 1 percent real. Given that the value proposition of stocks changes dramatically with big price changes, there is obviously no one stock allocation that can work for any investor at all times. Investors need tools like this to learn when they need to change their allocations.

I don?t think it should be too hard to understand why The Stock-Selling Industry desperately wants to keep tools like this out of the hands of middle-class investors. All industries would like their customers to believe that their product is worth buying at any possible price. But when too many become convinced that Buy-and-Hold can work, the insane level of overvaluation that follows causes an economic crisis (this has happened four times in U.S. history now ? we have not since 1900 had an economic crisis that was not preceded by a time of insane stock overvaluation and we have not had a time of insane overvaluation that did not produce an economic crisis). There comes a point when marketing considerations need to take a back seat to preservation of our free market economic system, which cannot survive if all middle-class investors see their retirement savings wiped out (the historical data shows that we are likely to see another 65 percent price drop from where we stand today in the event that stocks continue to perform in the future anything at all as they always have in the past).

The tool that is used by those informed about valuations to predict long-term returns (short-term returns cannot be predicted ? it is true that short-term timing does not work) is ?P/E10?. The P/E10 value is the price of the S&P index over the average of the last 10 years of earnings. Yale Economics Professor Robert Shiller (author of Irrational Exuberance) has been showing with research for 30 years now that P/E10 can be used to effectively predict long-term returns. Arends pointed out in an earlier article that: ?This ratio [P/E10] has been a powerful predictor of long-term returns? and that ?valuations is by far the most important issue for investors.?

Norbert Schenkler, the financial planner who prepared the graphic, concluded that: ?The evidence is pretty incontrovertible. Valuation-Informed Indexing?is everywhere superior to Buy-and-Hold over 10-year periods.? The one exception found by Schenkler, the late 1990s, no longer applies since the onset of the stock crash (the graphic was prepared prior to the crash).

Shiller used the P/E10 tool to warn us of the economic crisis that began in 2008 in his book (published in March 2000). He said that in the event that stocks performed from 2000 forward as they always have in the past: ?The real losses could be comparable to the total destruction of all the schools in the country, or all the farms in the country, or possibly even all the homes in the country.?

46th over: England 127-1 (need 330 to avoid an innings defeat; Cook 86, Trott 0) That was a lovely ball from Zaheer Khan, pitching on leg and catching Compton low on the shin. Meanwhile, at the other end, Cook takes his life in his hands with a swished sweep. He gets four, while a miss would have had him out lbw.

"Along the lines of Trott and catches not taken," fibs Matthew, who has a good story anyway so what the hell. "I once managed to insert my foot into the front wheel of my bicycle and fly head over handlebars onto the pavement. Convinced my parents that the neighbour kid did it to me."

WICKET! Compton 37 lbw Khan (England 123-1) Khan goes back to over the wicket and catches Compton full in front of the stumps. Slight question of whether it pitched outside leg but, no, the replays show that was fine. Dhoni must be breathing a sigh of relief after that missed stumping. Here comes Trott, on a pair.

45th over: England 123-0 (need 330 to avoid an innings defeat; Cook 82, Compton 37) Khan comes round the wicket to Compton and the batsman is late and beaten on the inside edge. Dhoni takes a tumbling catch behind. More than a whisper of reverse now. But then ...

44th over: England 123-0 (need 330 to avoid an innings defeat; Cook 82, Compton 37) Dhoni has just missed the simplest stumping. Compton came dancing down the wicket and was entirely beaten by the flight. Dhoni simply didn't react, the ball bouncing off him and harmlessly to leg. A shocker from the Indian captain.

43rd over: England 120-0 (need 330 to avoid an innings defeat; Cook 80, Compton 36) Khan's not exactly roaring in, hurling the thing down at a lick under 80mph. But there is a suspicion of reverse, a whisper at this stage. Compton appears unperturbed and prods a sharp single to Yuvraj at point. Cook scraped home by an inch. A run out then wouldn't have been exactly ideal for England. Khan then brings one back sharply from outside off and, despite the fact it hits the bat first, Khan gives it a good appeal anyway.

42nd over: England 119-0 (need 330 to avoid an innings defeat; Cook 80, Compton 35) A silly point has come in for Compton now as Ashwin does the batsman with his other one, second ball. His third raps Compton on the pad, jagging back from well outside off but probably heading past the leg stump. Leg bye, followed by a couple of singles.

"Good morning Tom," chirps the unprepared Chris Bourne. "Not being a great cricketer, even at school, I was never very well prepared. But I suppose the nadir was coming out in suede hush puppies paired with one red and one yellow sock, on account of having to borrow boots, and discovering that nobody, but nobody, had feet as large as mine.

"Now that Hope is propping at the bar with her moth-eaten falsies and her come-hither pout, we are firmly into the jinx zone, so the least said about the match the better. It is, however, another opportunity for Ian Ronald to play a Significant Innings, as opposed to knocking off centuries at the fag end of a dead rubber. 41st over: England 116-0 (need 330 to avoid an innings defeat; Cook 79, Compton 34) Cook chops Khan to the boundary. A full wide one outside off is not something Cook needs a second invitation for. He leaves the final ball of the over, which cut in from outside off and fizzed past his off stump.

"Re. getting into hopeless situations," emails a full and frank Harry Tuttle, at this time of the morning too. "The first time I had sex with my ex she cried. We stayed together for seven years."

40th over: England 112-0 (need 330 to avoid an innings defeat; Cook 75, Compton 34) Ashwin bowls from the other end, his wobbley-armed run-up sending a series of well-pitched-up deliveries to in and around Cook's feet. The batmsan forces a single into the leg side to remove the prospect of Nelson striking. It's a noticeably less attacking field now, with just a short leg and slip in to Compton.

39th over: England 111-0 (need 330 to avoid an innings defeat; Cook 74, Compton 34) Zaheer Khan opens proceedings coming over the wicket to Compton, with two slips waiting behind. His first three are sighters at or around the off stump, his fourth is a slower ball bowled out his knuckles which Compton blocks easily enough. An attempted yorker, with a touch of reverse, from around the wicket finishes a maiden. Nelson is is still on...

Apparently Matt Prior was in the altogether moments before he was called into bat yesterday, not expecting those above him to crumble quite so ineptly. A desperate scramble for pads, clothes and dignity ensued. So, what's the least prepared you've been before an innings - we're talking string jockstrap, and rolled up newspaper as a thigh pad? Also, in honour of Jonathan Trott, we may as well hear catches that were given that you know you didn't take too.

Early news is that the pitch has apparently not fallen apart overnight, with the weather not being quite so hot as expected. So that's something for England, who will no doubt find themselves hoping to simply bat defensively for as much of the next two days as they can manage. Which reminds me - when was the last time you got yourselves into something hopeless?

What passes for a preamble at this time of the morning: In 1999, a friend and backpacked around India in the mistaken belief (on my part) we were hippies. We arrived in Ahmedabad after 48 hours in the back of a jeep that bounced and bruised us sleeplessly over the desert. Tired, ratty and spoiling for a fight, we didn't take to the place and left as soon as we could. I wrote, in my somewhat pretentious diary, that it was "the most unfriendly place on earth".

It was a statement base on supposition, preconception and fear and is likely entirely inaccurate. Had I spent longer in town, I'm sure I would have come to have loved it. But I didn't. I high-tailed it to Bhavnagar.

I mention this not because my teenaged travelling is of interest but because it bears a parallel to England's travails. Turn up to the crease in Ahmedabad, freak out and go mad (Belly?) and you're out of there before you've had time to get the feel of the place. Take the time to stick around and soak in the atmosphere, and you might find yourselves on 111 without loss, thinking 'Bugger Bhavnagar, let's stick about'. Fortunately for England fans, that's just what Cook and Compton did last night.

Groundbreaking for Historical Society

BOONE COUNTY (WIFR) -- Construction is just getting started out in Belvidere, on a pretty sizeable expansion of the Boone County Historical Society's museum.

The project will join two existing buildings in Belvidere, to create a much larger space. The move is a long time coming.

Organizers tell us the museum's board and the Boone County taxing district have been trying to raise the necessary funds for about 10 years. Construction is expected to be done by late spring or early summer next year.
